Age Requirement: You must be at least 18 years of age to use ArtWiz. By using the Service, you represent that you meet this age requirement.

Account Creation: To access certain features, you must create an account by providing accurate and complete information, including your email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security: You agree to notify us immediately at support@artwiz.com if you suspect any unauthorized access to your account.

ArtWiz provides an AI-powered virtual staging platform designed for artists, photographers, galleries, and creative professionals. Our Service allows you to:

• Upload digital images of your artwork
• Generate photorealistic room stagings using artificial intelligence
• Specify artwork dimensions for true-to-scale visualization
• Select framing options and interior environment styles
• Download and use generated staging images for professional purposes

The Service utilizes third-party AI technology (Google Gemini) to generate staging images. Results may vary, and we do not guarantee specific outcomes.

Free Trial: New users may access a limited number of free staging generations to evaluate the Service.

Subscription Tiers: We offer various subscription plans including:

• Starter Plan: A credit-based plan for occasional use
• Professional Plan: A monthly subscription with enhanced features and usage limits

Billing: Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis (for subscription plans) or as a one-time payment (for credit packs).

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

Price Changes: We reserve the right to modify pricing with 30 days' notice. Changes will apply to the next billing cycle after the notice period.

Refunds: Due to the nature of AI-generated content, refunds are generally not provided once staging generations have been used. However, we may consider refund requests on a case-by-case basis for unused portions of subscriptions. Contact support@artwiz.com for assistance.

Your Content: You retain full ownership of any artwork images you upload to ArtWiz. By uploading content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service.

Generated Stagings: You own the staging images generated from your artwork. You may use these images for personal and commercial purposes, including marketing, portfolio display, and client presentations.

Watermarking: Free-tier and certain starter-tier users may have watermarks applied to generated images. Upgrading to an eligible plan removes watermarking.

Our Intellectual Property: ArtWiz, including its name, logo, software, design elements, and AI technology integration, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service.

Representations: You represent and warrant that you own or have the necessary rights to upload and use any artwork you submit, and that your content does not infringe on any third-party intellectual property or other rights.

You agree not to use ArtWiz to:

• Upload content that is illegal, obscene, defamatory, or infringes on third-party rights
• Generate content that promotes violence, discrimination, or illegal activities
• Attempt to circumvent usage limits, security measures, or access restrictions
• Use the Service to harm, harass, or defraud others
• Interfere with the operation of the Service or its underlying infrastructure
• Resell, sublicense, or commercially exploit the Service without authorization
• Use automated systems (bots, scrapers) to access the Service without permission

We reserve the right to suspend or terminate accounts that violate these policies without prior notice.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, secure, or error-free.

AI-Generated Content: Staging images are generated using artificial intelligence and may contain imperfections, inaccuracies, or unexpected results. We do not guarantee that generated images will meet your specific requirements or expectations.

Third-Party Services: The Service relies on third-party providers (including Google, Stripe, and cloud hosting services). We are not responsible for outages, errors, or issues caused by these providers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTWIZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Damage to reputation or goodwill
• Any damages arising from your use or inability to use the Service

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless ArtWiz and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you upload or generate through the Service

By You: You may cancel your subscription or delete your account at any time through your account settings or by contacting us at support@artwiz.com.

By Us: We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. We will attempt to provide reasonable notice when possible.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data, including uploaded artwork and generated stagings, after a reasonable retention period. You remain responsible for any fees incurred prior to termination.

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ArtWiz regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.
